Teacher Facing Sex Charges Plans Insanity Defense, Attorney Says

TAMPA - Debra LaFave, a teacher accused of having sex with a 14-year-old male student, is expected to use an insanity defense at her trial in the spring, her attorney said Tuesday.

Attorney John Fitzgibbons said in a hearing before Judge Wayne Timmerman that two doctors have evaluated LaFave, 24, over the past several months. They also have examined medical records that date back several years, he said.

``Debbie has some profound emotional issues that are not her fault,'' Fitzgibbons said after the hearing. ``I think that once anyone reads what the doctors have to say, they will understand a lot more about what went on.''

Prosecutors' records, including taped phone conversations and DNA evidence, are expected to be released as public record today. Officials with the state attorney's office said information that might identify the juvenile victim must be censored before the records are released.

LaFave was arrested in June on charges of committing lewd or lascivious battery on a person younger than 16. She faces similar charges in Marion County.

Investigators say LaFave had sex with the boy in a portable classroom at Greco Middle School, in the back of her sport utility vehicle in Ocala and at the Riverview town house she shared with her husband. She had been married for less than one year.

After the charges, LaFave was suspended from her teaching job. Her husband filed for divorce in August.

The trial for the Hillsborough charges initially was scheduled for Dec. 6. On Tuesday, the trail was rescheduled for April 25.
